1. Agreement

These Terms and Conditions ("Terms") govern your access to and use of the Kruze Commute mobile application, the website at kruze.in and related services (together, the "Platform"), operated by Invicto Technologies Private Limited ("Kruze", "we", "us" or "our"), a company incorporated in India.

By creating an account, booking a ride or otherwise using the Platform, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Platform.

2. What Kruze is, and what it is not

Kruze is a technology aggregator. We provide an application that connects riders seeking transport with independent third-party driver partners who operate their own or leased vehicles.

We are not a transport company, taxi operator or common carrier, and we do not own, lease or control the vehicles or employ the driver partners. The contract for carriage is between you and the driver partner. Kruze acts as an intermediary and payment facilitator for that transaction.

3. Eligibility and your account

  • You must be at least 18 years old and legally capable of entering into a binding contract.
  • You must register with a valid mobile number and provide accurate, current information, and keep it updated.
  • Your account is personal to you. You are responsible for all activity under it and for keeping your device and login credentials secure.
  • You may not create an account on behalf of another person without authority, or hold more than one account without our written consent.
  • Tell us immediately at support@kruze.in if you suspect unauthorised use of your account.

4. Bookings, cancellations and no-shows

  • A booking request is an offer to a driver partner. A ride is confirmed only when a driver partner accepts it in the App.
  • We do not guarantee the availability of a vehicle at any given time or location. Availability depends on driver partner supply, traffic, weather, local restrictions and other factors outside our control.
  • Estimated times of arrival and estimated fares are indicative only and are not binding.
  • You may cancel a booking in the App. A cancellation fee may apply if you cancel after the free cancellation window shown at the time of booking, or if the driver partner has already reached the pickup point.
  • If you do not board within the waiting time shown in the App, the driver partner may cancel and a no-show fee may apply.
  • Repeated cancellations or no-shows may result in restrictions on your account.

5. Fares and payment

  • Fares are calculated on the basis of distance, time, vehicle category, applicable base and minimum fares, and any waiting charges, and are shown before or during the ride.
  • Dynamic pricing may apply during periods of high demand, adverse weather or limited supply. Any such multiplier is shown before you confirm the booking.
  • Tolls, parking charges, state permits, airport entry fees, night charges and applicable taxes including GST are additional and are payable by you.
  • You may pay by the payment methods available in the App, including UPI, cards, wallets and cash where offered. Online payments are processed by RBI-authorised payment gateways; we do not store your full card or UPI credentials.
  • If a payment fails or a cash ride goes unpaid, the outstanding amount is added to your account and must be cleared before your next booking.
  • Refunds, where due, are credited to the original payment method within the timelines of the relevant payment provider, usually 5 to 7 working days.
  • Waiting charges, cleaning fees for damage or soiling, and toll or parking reimbursements may be charged to your account after the ride ends.

6. Promotions and referrals

We may offer promotional codes, free rides, discounts and referral rewards. These are personal to you, have no cash value, cannot be transferred or combined unless expressly stated, are subject to the specific terms published with them, and may be withdrawn or modified at any time. We may cancel any benefit and suspend the account if we reasonably believe it was obtained by fraud, abuse or misrepresentation.

7. Your obligations as a rider

  • Behave lawfully and with courtesy towards driver partners, other riders and our staff. Harassment, discrimination, threats, violence or abusive language are not permitted.
  • Wear a seatbelt and comply with all applicable traffic and transport laws.
  • Do not carry or transport illegal, hazardous, flammable or prohibited goods, or any animals other than in an appropriate carrier where the driver partner agrees.
  • Do not smoke, consume alcohol or use narcotics in the vehicle.
  • Do not damage, soil or interfere with the vehicle or its equipment. You are liable for repair or cleaning costs you cause.
  • Do not exceed the seating capacity of the vehicle.
  • Do not use the Platform for any unlawful purpose, to reverse engineer it, to scrape or extract data, to introduce malware, or to interfere with its operation.

8. Safety

The App provides safety features including live trip sharing, an emergency SOS button, masked calling and post-trip feedback. In an emergency you should first contact the police on 112. You consent to us sharing your trip and location data with emergency responders, the police and your registered emergency contacts where there is a credible risk to safety.

9. Ratings, feedback and lost items

Riders and driver partners rate each other after every trip. Ratings help maintain quality and safety on the Platform, and consistently low ratings may lead to restrictions on your account. Reviews must be accurate and must not be defamatory or abusive.

If you leave an item in a vehicle, report it in the App as soon as possible. We will make reasonable efforts to help you contact the driver partner, but we are not responsible for lost or damaged belongings. A convenience fee may apply for return trips arranged for this purpose.

10. Intellectual property

The Platform, including the Kruze and Kruze Commute names, logos, software, designs, text and other content, is owned by or licensed to Invicto Technologies Private Limited and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to use the App for its intended purpose. All other rights are reserved. You may not copy, modify, distribute, sell or create derivative works from any part of the Platform.

11. Third-party services

The Platform integrates third-party services such as maps, navigation, payment gateways and messaging providers, and may link to third-party websites. We are not responsible for the content, accuracy, availability or practices of those services, and your use of them is governed by their own terms.

12. Disclaimers

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose and non-infringement.

We do not warrant that the Platform will be uninterrupted, timely, secure or error-free, and we do not guarantee the quality, suitability, safety or ability of any driver partner. Driver partners are independent contractors responsible for their own vehicles, licences, permits, insurance and conduct. We carry out reasonable verification of documents but do not accept liability for the acts or omissions of driver partners.

13. Limitation of liability

To the maximum extent permitted by law, Kruze and its directors, officers, employees and agents will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for loss of profit, revenue, data, goodwill or business opportunity, arising out of or in connection with your use of the Platform, whether or not we were advised of the possibility of such damages.

Our aggregate liability for any claim arising out of or relating to the Platform or a particular ride will not exceed the higher of the fare paid for the ride giving rise to the claim, or INR 1,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold harmless Invicto Technologies Private Limited and its directors, officers, employees and agents from any claim, demand, loss, liability, cost or expense, including reasonable legal fees, arising out of your use of the Platform, your breach of these Terms, your violation of any law, or your infringement of the rights of any third party.

15. Suspension and termination

You may stop using the Platform and delete your account at any time. We may suspend or terminate your access, with or without notice, if we reasonably believe you have breached these Terms or the law, engaged in fraud or unsafe conduct, or created a risk to other users or to us. Outstanding dues survive termination, as do Sections 10, 12, 13, 14 and 17.

16. Grievance redressal

For any complaint about a ride, a charge or the Platform, contact us first through Help in the App or at support@kruze.in. If your complaint is not resolved to your satisfaction, you may escalate it to our Grievance Officer, appointed under the Information Technology Act, 2000 and the rules made under it:

We acknowledge grievances within 24 hours and aim to resolve them within 15 days of receipt.

17. Governing law and disputes

These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms that is not resolved through our grievance process will be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be New Delhi and the proceedings will be in English. Subject to the above, the courts at New Delhi will have exclusive jurisdiction.

18. Changes to these Terms

We may amend these Terms from time to time. The revised Terms take effect when posted on this page, and we will update the "Last updated" date. For material changes we will give notice in the App or by email. Continuing to use the Platform after that means you accept the revised Terms.
